LAIYR™ ACCEPTABLE USE POLICY


1. PURPOSE

This Acceptable Use Policy ("AUP") describes activities that are prohibited when using the Laiyr™ platform and Service. This AUP is incorporated into and forms part of the Laiyr™ Terms of Service. Violations of this AUP may result in immediate suspension or termination of your account, removal of your registry listing, and other remedies available to Laiyr.


2. WHO THIS APPLIES TO

This AUP applies to all users of the Service, including Free tier users, paid subscribers, and authorized representatives of brands.


3. PROHIBITED CONDUCT

3.1 Impersonation and Unauthorized Brand Declarations

You may not:

(a) Register a brand on Laiyr that you do not own or are not authorized to represent;

(b) Make Brand Truth declarations on behalf of a brand without proper authorization from that brand;

(c) Impersonate another brand, business, or individual;

(d) Misrepresent your affiliation with a brand, organization, or individual;

(e) Use the Service to claim certifications, licenses, or credentials that you do not actually hold;

(f) Falsely claim ownership or licensure of trademarks, patents, or other intellectual property; or

(g) Use the Service to claim a domain that you do not own or have authorization to publish to.

3.2 False, Misleading, or Deceptive Declarations

You may not submit Brand Truth declarations that:

(a) Are knowingly false or misleading;

(b) Make claims that violate the Federal Trade Commission Act or similar consumer protection laws;

(c) Make health, safety, medical, or therapeutic claims that are unsupported by qualified evidence or that violate FDA, FTC, or other applicable regulations;

(d) Make environmental, sustainability, or "green" claims that violate Federal Trade Commission Green Guides or similar regulations;

(e) Make pricing, savings, or discount claims that are deceptive;

(f) Falsely associate your brand with celebrities, public figures, organizations, or events;

(g) Falsely claim awards, recognitions, certifications, rankings, or affiliations;

(h) Misrepresent the nature, ingredients, origin, or characteristics of your products or services; or

(i) Are designed to deceive consumers, AI Platforms, or competitors.

3.3 Illegal Activities

You may not use the Service:

(a) For any unlawful purpose or in violation of any local, state, federal, or international law or regulation;

(b) To facilitate any illegal activity, including but not limited to fraud, money laundering, illegal sales of controlled substances, illegal gambling, or human trafficking;

(c) To violate any court order, regulatory order, or legal injunction;

(d) To evade taxes, tariffs, sanctions, or trade restrictions;

(e) To engage in price-fixing, market allocation, or other anticompetitive conduct; or

(f) In any way that violates applicable export control laws, including U.S. Office of Foreign Assets Control (OFAC) sanctions.

3.4 Harmful, Discriminatory, or Hateful Content

You may not use the Service to declare, publish, or distribute content that:

(a) Promotes violence, terrorism, or self-harm;

(b) Contains hate speech, slurs, or content that demeans individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics;

(c) Sexualizes, exploits, or endangers minors;

(d) Constitutes harassment, bullying, or stalking;

(e) Threatens, incites, or facilitates physical harm; or

(f) Is otherwise harmful, abusive, or offensive.

3.5 Intellectual Property Violations

You may not:

(a) Use the Service to infringe upon any third party's copyright, trademark, patent, trade secret, or other intellectual property rights;

(b) Declare ownership or licensure of intellectual property you do not own or are not authorized to use;

(c) Use other brands' trademarks in a way likely to cause consumer confusion;

(d) Reverse engineer, decompile, or attempt to extract the source code of the Service except as expressly permitted by law;

(e) Copy, reproduce, modify, or create derivative works of the Service or Laiyr's proprietary technology;

(f) Remove, alter, or obscure any proprietary notices on the Service; or

(g) Use Laiyr's trademarks, logos, or brand assets without our prior written authorization, except for permitted descriptive references to the Service.

3.6 System Abuse

You may not:

(a) Attempt to gain unauthorized access to the Service, other accounts, or related systems;

(b) Probe, scan, or test the vulnerability of the Service except as part of a coordinated security disclosure program (contact security@laiyr.ai);

(c) Interfere with or disrupt the Service, servers, or networks connected to the Service;

(d) Use automated systems (including bots, scrapers, or scripts) to access the Service except through our official API and within published rate limits;

(e) Submit malware, viruses, worms, trojans, or other malicious code;

(f) Engage in denial-of-service attacks or distribute amplification attacks;

(g) Bypass, attempt to bypass, or circumvent any access controls, rate limits, or security features;

(h) Use the Service in a way that imposes an unreasonable load on our infrastructure;

(i) Attempt to manipulate or game the Brand Strength Score, accuracy measurements, or corroboration scoring through artificial means;

(j) Submit fraudulent or manufactured "proof documents" for credentials, certifications, or licenses; or

(k) Use the Service to perform automated decision-making about individuals in ways that produce legal or similarly significant effects without proper authorization and disclosure.

3.7 Spam and Abuse of Communications

You may not:

(a) Use the Service to send unsolicited communications;

(b) Use the Service to harvest email addresses or other contact information;

(c) Use the Service to violate the CAN-SPAM Act, GDPR consent requirements, or similar communications laws; or

(d) Send communications that include misleading subject lines, headers, or sender information.

3.8 Misuse of Public Registry

You may not:

(a) Use the Laiyr™ registry listing to make claims you have not declared in your Brand Truth;

(b) Manipulate registry visibility through false declarations;

(c) Engage in coordinated efforts to influence Brand Strength Scores artificially;

(d) Attempt to remove or modify other brands' registry listings; or

(e) Use registry data scraped from laiyr.ai for purposes not authorized by these Terms.

3.9 Competitive Misconduct

You may not:

(a) Use the Service to make false or disparaging declarations about competitors;

(b) Register or attempt to manage another brand's identity to harm that brand;

(c) Use Laiyr to interfere with another brand's relationships, contracts, or business operations; or

(d) Use insights about another brand's representation to engage in unfair competition.


4. CONTENT-SPECIFIC RESTRICTIONS

4.1 Regulated Industries

If your brand operates in a regulated industry, you are responsible for compliance with all applicable regulations governing your declarations, including:

  • Healthcare: HIPAA, FDA labeling requirements, state medical practice acts, professional licensure rules
  • Financial services: SEC, FINRA, FFIEC, state consumer credit laws
  • Cannabis and CBD: Federal and state cannabis laws, state-specific advertising rules
  • Alcohol: TTB regulations, state alcohol beverage commission rules
  • Insurance: State insurance department regulations
  • Legal services: State bar advertising rules
  • Children's products: COPPA, CPSC requirements

Laiyr does not provide regulatory compliance advice. You are solely responsible for ensuring your declarations comply with all applicable industry-specific regulations.

4.2 Restricted Categories

The Service may not be used to declare brands operating in the following categories:

(a) Adult content, sexual services, or pornography; (b) Illegal drugs or drug paraphernalia; (c) Weapons, explosives, or military equipment in violation of applicable law; (d) Counterfeit goods; (e) Stolen property; (f) Multi-level marketing schemes that violate FTC pyramid scheme guidance; (g) Predatory financial services (e.g., payday lending in violation of state law); (h) Services that primarily facilitate violations of these prohibitions.

4.3 High-Caution Categories

The following categories are permitted but subject to enhanced scrutiny. Laiyr may require additional verification, may decline to publish certain claims, or may impose category-specific restrictions:

(a) Healthcare and wellness; (b) Financial services and cryptocurrency; (c) Cannabis-derived products (CBD, hemp); (d) Dietary supplements; (e) Children's products and services; (f) Political organizations and campaigns.


5. ENFORCEMENT

5.1 Investigation

We reserve the right (but have no obligation) to investigate suspected violations of this AUP. We may review declarations, supporting documents, account activity, and other information as part of an investigation.

5.2 Actions We May Take

If we determine, in our reasonable discretion, that a violation has occurred, we may take any of the following actions:

(a) Issue a warning; (b) Require correction or removal of specific declarations; (c) Require additional verification; (d) Suspend specific Service features (e.g., catalog read-access, MCP app, registry visibility); (e) Suspend your account temporarily; (f) Terminate your account permanently; (g) Remove your brand from the public registry; (h) Withdraw or revoke your published Verified Brand Record; (i) Report violations to law enforcement, regulators, or affected third parties; or (j) Pursue any other remedy available under the Terms of Service or applicable law.

5.3 Automatic Enforcement for High-Severity Violations

The following categories of violations may trigger automatic suspension or unpublishing of your Verified Brand Record from Laiyr-controlled publication endpoints while we investigate:

(a) Brand impersonation or registration of a brand you do not own or are not authorized to represent (Section 3.1);

(b) Knowingly false declarations of certifications, licenses, or credentials you do not hold (Section 3.1(e));

(c) False or misleading claims that violate the Federal Trade Commission Act, FDA labeling requirements, or other applicable consumer protection law (Section 3.2);

(d) Use of the Service to engage in illegal activity (Section 3.3);

(e) Submission of fraudulent or manufactured proof documents (Section 3.6(j));

(f) Coordinated attempts to manipulate the Brand Strength Score or other Service metrics (Section 3.6(i)); and

(g) Use of the Service in a manner that creates immediate risk of harm to consumers, other brands, or the integrity of the Laiyr registry.

Automatic enforcement is designed to protect the public, other brands, and the integrity of the Laiyr ecosystem. You will be notified of any automatic enforcement action and given an opportunity to respond as described below.

5.4 No Refunds for Violations

If we suspend or terminate your account for a violation of this AUP or the Terms of Service, you are not entitled to a refund of any fees paid.

5.5 Notice and Appeal

Where reasonably possible, we will notify you of an enforcement action and provide an opportunity to respond. We may take immediate action without prior notice in cases involving (i) urgent legal or regulatory requirements, (ii) ongoing harm to third parties, (iii) security threats, or (iv) clear and material violations.


6. REPORTING VIOLATIONS

If you believe another user is violating this AUP, including making false claims about a brand you own or impersonating your brand, please report it to abuse@laiyr.ai with:

  • The brand name in question
  • The specific claim or behavior at issue
  • Evidence supporting your report (e.g., trademark registrations, regulatory filings)
  • Your contact information

We will review reports promptly and take appropriate action.


7. CHANGES TO THIS POLICY

We may update this Acceptable Use Policy from time to time. When we make material changes, we will notify you by email or through the Service. Your continued use of the Service constitutes your acceptance of the updated AUP.
